What is the legal basis for the construction diary?

In the context of private construction projects, there is no mandatory obligation to keep a construction diary. Furthermore, there are no formal requirements regarding the content or structure of the construction documentation.

In contrast, the situation is different if an architect has been contractually obliged to supervise the construction project. In this case, he is required to document the supervision by means of a construction diary in accordance with the basic services defined by the HOAI.

If necessary, a construction diary can also be managed by a site manager. For larger construction projects, daily management of the site diary is a must, while on smaller construction sites it is sufficient to update the document each time the construction site is visited.

Doesn't the daily construction report replace the construction diary?
